1. Introduction

Welcome to Txtivo ("we," "our," or "us"). We are committed to protecting your personal information and your right to privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website (the "Site") or use our SaaS platform, API, and mobile applications (collectively, the "Services").

By accessing or using our Services, you consent to the data practices described in this policy. Txtivo operates from Kathmandu, Nepal, but serves a global user base. We adhere to applicable international data protection standards.

2. Information We Collect

A. Personal Information You Provide

  • Account Data: Name, email address, phone number, password, and profile image.
  • Business Verification Data (A2P 10DLC): For users utilizing SMS services, we collect legal business names, Tax IDs (EIN/PAN), physical addresses, and authorized representative details to comply with US Carrier regulations (The Campaign Registry).
  • Payment Data: We collect data necessary to process your payment (e.g., credit card details), which is stored by our payment processor, Stripe. We do not store full credit card numbers on our servers.

B. Content and Usage Data

  • Customer Contacts: We store the contact lists (leads) you upload to facilitate your marketing campaigns.
  • Message Content: We process and store the text of SMS, emails, and campaign templates you create.
  • Usage Logs: IP address, browser type, operating system, and access times.
  • Meta Lead Ads Data: When a customer connects a Meta account, we process authorized Facebook Page and Instant Form metadata, lead form submissions, ad and campaign identifiers, and the consent response captured by the form. Meta access tokens are encrypted at rest.

3. How We Use Your Information

We use the information we collect or receive:

  • To facilitate account creation and secure logon.
  • To deliver services (sending SMS/Emails via Twilio/SendGrid).
  • To process payments and manage subscriptions via Stripe.
  • To ensure Compliance (Crucial): We use your business details to register your Brand and Campaign with The Campaign Registry (TCR) to ensure your messages are not blocked by carriers.
  • To protect our Services from fraud and abuse.
  • To receive authorized Meta Instant Form leads, document their SMS consent, and enroll eligible leads in the customer's selected messaging campaign.

4. Sharing Your Information

We do not sell your personal data. We share information only with:

  • Telecommunication Partners (Twilio & Carriers): Shared strictly for A2P 10DLC registration (Legal Name, EIN, Address).
  • Payment Processors: Stripe processes your payments.
  • Platform Providers: Meta supplies authorized Page and lead-form data. We use that data only to provide the integration requested by the Txtivo customer.
  • Legal Requirements: To comply with applicable laws or court orders.

5. Data Retention

We retain your personal information as long as your account is active. A2P Registration Data is retained indefinitely to maintain your active status with US Carriers. Wallet transaction logs are retained for 7 years for tax purposes.

Disconnecting Meta removes the stored Meta connection, Page tokens, and form configuration and pauses affected live campaigns. A Meta user may also submit a deletion request through Meta's application settings; Txtivo processes the signed request and returns a confirmation code and status URL. Campaign contacts and messaging records may remain where the Txtivo customer has an independent legal obligation to retain them, subject to applicable law and the customer's deletion instructions.
